Terms of Service

The short version. Dragon Wispr turns your speech into text in any Windows app. Free includes 15 minutes a month; Pro includes 4,000 minutes a month. Payments are handled by Paddle, our Merchant of Record. Your audio is processed transiently to produce your text. Our speech-to-text provider is configured for zero data retention and never trains on it. We never store audio or transcripts. The text is produced by AI and can contain mistakes, so read it before you send it. Your first paid purchase can be refunded in full within 14 days, and your statutory rights always apply.

The full terms below are what legally applies.

1. Who we are and what these terms cover

Dragon Wispr (the “Service”) is provided by [TailorUp legal name], trading as TailorUp (“we”, “us”). Our full details are in the Legal notice. These Terms of Service (“Terms”) apply to the Dragon Wispr desktop app, the website at https://dragonwispr.com, and the online service behind them. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal data and our Refund Policy explains refunds and your right of withdrawal. Both form part of these Terms.

2. The Service

Dragon Wispr is a system-wide dictation app, currently for Windows (macOS is planned). You hold a hotkey (by default Right Ctrl), speak, and release; the Service converts your speech to text and the app copies it to your clipboard. If you turn on auto-paste, the app also pastes the text into the app you are using. A hands-free tap mode is available. The Service detects the language you speak, or you can lock it to one language.

Features described as “coming soon” or “planned”, including Dragon mode (translation into Simplified Chinese before pasting), a custom dictionary and additional target languages, are not part of the Service until we release them. We do not promise that they will be released or by any date, and they are not a basis for any purchase.

The Service is in early access. Occasional errors or interruptions are possible. We work to keep it available but do not guarantee uninterrupted service.

3. AI-generated text

  • The Service uses AI models from third-party providers: speech-to-text currently runs on Whisper large-v3 turbo hosted by Groq, and Dragon mode will use Qwen3-32B hosted by DeepInfra. We may change providers or models to keep quality, speed or cost right; the current list is always in the Privacy Policy.
  • The output can contain errors, including with names, numbers, technical terms and translations. Read the text before you send or rely on it. Do not use the Service where an error could put anyone’s health, safety, money or legal position at risk without checking the result.
  • Neither we nor our providers use your audio or text to train AI models.

4. Your account

  • You sign in with your email address, using a link or a one-time code we email to you.
  • You must be at least 16 years old and give an email address you control. Keep access to that mailbox secure: anyone who can read it can sign in as you.
  • An account is for one person. Do not share it or sell access to it. Tell us at support@dragonwispr.com if you think someone else is using your account.
  • You can delete your account at any time in the desktop app (see the Privacy Policy).

5. Plans and minutes

  • Minutes are measured as the length of the audio you send for transcription, as reported by our speech-to-text provider, rounded up to the next tenth of a second. Time you spend not dictating does not count.
  • Each plan includes a number of minutes per monthly usage period: 15 on Free and 4,000 on Pro (over 2 hours a day). The allowance resets at the start of each period and unused minutes do not roll over. We tell you when you have used 80%. When you reach the allowance, dictation pauses until the next period, or, on Free, until you upgrade.
  • To keep the Service fair and protect it from abuse, we apply rate limits (for example a maximum number of dictations per minute, hour or day) and a maximum length per dictation. The current limits are described in the app and documentation.
  • The Free plan needs no payment card.

6. Purchases, subscriptions and Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a paid plan, you buy it from Paddle, and Paddle’s Buyer Terms apply to the purchase in addition to these Terms. Paddle calculates and collects any VAT or sales tax and issues your invoice or receipt. Euro prices include VAT and are the same in every EEA country. US dollar prices are before any applicable tax, which Paddle adds at checkout.

  • Paid plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly) until you cancel. You can cancel at any time; cancellation stops future renewals, and you keep your plan until the end of the period you have paid for.
  • If you upgrade from Free to Pro, or switch Pro from monthly to yearly billing, the change applies straight away and Paddle may charge a pro-rated amount. If you switch from yearly to monthly billing or move back to Free, the change takes effect from your next billing period.
  • If we change a plan’s price, we will tell you by email at least 30 days before the change applies to you; you can cancel before then.
  • If a payment fails, Paddle may retry it. If it still fails, your account moves to the Free plan.
  • As a consumer in the EU you can withdraw from a purchase within 14 days; see Withdrawal from the contract. Our Refund Policy adds to your statutory rights and never reduces them.

7. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or to harass, defraud or harm anyone;
  • capture or transcribe other people’s speech without their consent, or without the notice the law requires where you are. The Service is meant for your own voice: if others can be heard, tell them first;
  • try to get around plan allowances or rate limits, share or resell your account, or use the Service as a general-purpose transcription API for other products;
  • interfere with, overload, probe or attack the Service, or reverse engineer it except where the law allows you to. Good-faith security research under our Security policy is welcome;
  • use automated means to create accounts or join the waitlist.

We may suspend or close accounts that break these rules. Where reasonable we will warn you first and tell you why.

8. Your content and your data

You own what you dictate and the text the Service returns to you. You give us only the permission we need to process it in order to provide the Service. Your audio is processed transiently to produce your text. Our speech-to-text provider is configured for zero data retention and never trains on it. We never store audio or transcripts. We do not use your dictations to train models. We keep only usage metadata (such as how many seconds you dictated, when, and the language detected) as described in the Privacy Policy.

Export and switching. You can download your data at any time in a common machine-readable format (JSON) from the desktop app, and delete your account whenever you like. There are no fees, notice periods or technical obstacles to leaving or to moving to another service. Because we do not store your dictations, there is nothing else of yours left with us.

9. The desktop app, updates and support

We give you a personal, non-exclusive, non-transferable licence to install and use the Dragon Wispr desktop app on devices you own or control, for as long as you have an account. Open-source components in the app are licensed under their own licences.

The app works with a global hotkey and your microphone. It only acts on the hotkey you configured and never records, stores or sends other keystrokes (see the Privacy Policy, “On your device”). It keeps the last ~2 seconds of microphone audio in memory only and only sends audio while you hold (or have toggled) the hotkey, plus about 300 milliseconds from just before you pressed it, so your first word is not cut off.

We provide the updates, including security updates, needed to keep the app working as described and secure,until at least 31 December 2031, and in any case for as long as the Service is offered. Updates go to the latest released version of the desktop app; if you do not install an update we told you about, we are not responsible for a problem that the update would have fixed.

10. Changes to the Service

We may change the Service, beyond what is needed to keep it working as described, only for a valid reason: for example to follow the law, to respond to a security issue, to replace a provider, to improve the Service, or to adapt to technical changes. Such changes come at no extra cost to you. If a change negatively affects your access to or use of a paid plan more than in a minor way, we will tell you clearly at least 30 days in advance, and you may end your subscription free of charge within 30 days of the change and receive a pro-rated refund of the unused prepaid period.

11. Ending the agreement

You can stop using the Service and delete your account at any time. We may end or suspend your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service entirely, we will give you at least 30 days’ notice where possible and refund the unused part of any prepaid period.

12. Our responsibility to you

We provide the Service with reasonable care and skill. If you are a consumer, you have legal rights when digital content or a digital service is not as described or not working properly, including under the EU Digital Content Directive (Directive (EU) 2019/770, in Greece Law 4967/2022): for example to have it brought into conformity, to a price reduction, or to end the contract. Nothing in these Terms affects those rights.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, under mandatory product liability law (including the rules implementing Directive (EU) 2024/2853 on liability for defective products), or for anything else that cannot be limited by law.

Subject to the paragraphs above, we are not responsible for losses that were not reasonably foreseeable, or for business losses (such as lost profit, revenue or data) if you use the Service for business purposes. Where the law allows a cap, our total liability to you is limited to the greater of the amount you paid for the Service in the 12 months before the claim and €50.

13. Changes to these Terms

We may update these Terms, for example when we add features or when the law changes. For material changes we will email you at least 30 days in advance; if you do not agree, you can cancel and close your account before they apply. The date at the top shows the latest version.

14. Governing law and disputes

These Terms are governed by the laws of Greece, and disputes go to the competent courts of Athens, Greece. If you are a consumer living in the EU, you also keep the protection of the mandatory rules of your country of residence and may bring proceedings in your local courts. Please contact us first: most problems can be solved quickly by email. You can also contact the consumer protection authority or an alternative dispute resolution body in your country.
